Legal Wednesdays: Directors and Officers Insurance

Well this post won’t be nearly as exciting as my last one: God Isn’t a Member of the Tea Party, but it might be helpful.  Here are the first two insurance posts for easy reference:

As you legally establish the new church, one of the things you should do is appoint directors and officers. Often times the Articles of Incorporation will ask you to list who the initial directors are.  When you get to filing the application for the 501c3, you will need to list the officers and directors.  The standard officers are: president, secretary and treasurer.  The officers can also be directors (I think that’s easiest), but they don’t have to be.  Usually the church planter is considered a director and fills the role of president.  If you have a management team, it is easiest to let these individuals serve in the role of directors of the organization.

Directors and officers insurance provides coverage in the event that your directors or officers are sued in relation to their duties as a director or officer with the church.  Claims can be made against the church and the directors and officers.  In some cases, the directors can be held personally responsible for the actions of the organization/church.  You will need this coverage as soon as the initial board of directors are formed.  Most directors/officers will not want to risk their personal assets by serving on the board, so it’s important to provide this coverage.  Of course in a church plant, chances are your directors and officers will also be pastors and likely won’t have a clue that they could be sued and will in blissful ignorance serve on the board without ensuring such insurance is in place icon wink Legal Wednesdays: Directors and Officers Insurance
